CANADIAN SPORT CENTRE PACIFIC BILLET PROGRAM
Terms & Conditions
 
1. Voluntary Participation. I have voluntarily chosen to apply to participate in the Program and have completed this Guest Application Form in the spirit of goodwill and friendship. I hereby represent and warrant that all persons in my party (myself included) are of good character and there is nothing to my knowledge that would preclude our acting as Guest(s) during the Games as part of the Program.

2. Acceptance of Host. If my application is accepted by Canadian Sport Centre Pacific (“CSC Pacific”) and I am accepted as a Guest in the Program, I agree to accept any Host assigned to me, regardless of their race, religion, lifestyle or national origin, and I agree to respect their cultural traditions and beliefs.

3. CSC Pacific’s Right of Termination. I acknowledge and agree that CSC Pacific  may terminate my participation in the Program and/or my status as a Guest at any time if I fail to comply with the provisions of this Agreement including, without limitation, if I become ineligible to be a Guest or engage in serious misconduct which in CSC Pacific’s opinion adversely affects the integrity and/or interests of the Program, CSC Pacific, Own the Podium 2010 (“OTP”), the Vancouver Organizing Committee for the 2010 Olympic and Paralympic Winter Games (“VANOC”), the International Olympic Committee (the “IOC”), the Canadian Olympic Committee (the “COC”), the International Paralympic Committee (the “IPC”), the Canadian Paralympic Committee (the “CPC”), any National Sport Federation (the “NSFs”) or any other organization participating in the Program.

4. No Liability for Unrelated Parties. I acknowledge and understand that none of the NSFs, OTP, VANOC, the Dominion of Canada, the Province of British Columbia, the City of Vancouver, the Resort Municipality of Whistler, the City of Richmond, the Municipality of West Vancouver, the IOC, the IPC, the COC, or the CPC, nor any department, agency, director, officer, trustee, member, minister, councilperson, servant, employee, agent, volunteer or representative of any of the foregoing entities (each, an “Unrelated Party”) shall incur any financial responsibility or liability of any kind or nature whatsoever by virtue of or arising from: (a) the Unrelated Party’s relationship with CSC Pacific, and/or (b) the Program.

5. Indemnity. I agree to indemnify and save harmless CSC Pacific, OTP, VANOC, the COC, the CPC, the NSFs and its past and present directors, officers, members, employees, volunteers, affiliates, agents and representatives (each an “Indemnified Party”) from any losses, claims, damages, actions, causes of action, costs and expenses that an Indemnified Party may sustain, incur or suffer at any time, either during or after my time in Metro Vancouver, which are based upon, arise out of or occur, directly or indirectly, by reason of any act or omission by me in connection with my participating in the Program (whether or not my application is successful) or otherwise arising out of this Agreement. I further understand, acknowledge and agree that CSC Pacific is in no way responsible or liable for the acts, omissions or negligence of any Host or any other individual (including any Guest) associated with the Program.

6. Assumption of Risk, Waiver and Release. I acknowledge that visiting and staying in the home of a Host may involve certain risks and dangers, including those caused by the Host. As between CSC Pacific and me, I expressly and specifically assume all such risks. Furthermore, to the fullest extent permitted by law, I hereby release, waive, covenant not to sue, and discharge CSC Pacific  and its past and present directors, officers, members, employees, volunteers, affiliates, agents and representatives, the IOC, the IPC, the COC, the CPC, VANOC, OTP, and the NSFs from any and all liability, claims, demands and causes of action whatsoever arising out of or related to any loss, damage , illness, or injury, including death, that may be sustained by me or loss or damage to any property belonging to me arising out of or related to my participating in the Program (whether or not my application is successful).

7. Security. CSC Pacific reserves the right to conduct a comprehensive security screening, including a criminal records search, police history information search and/or such other security checks and searches as a condition to participation in the Program, and I agree to fill out any forms and submit any personal information required for this process. I further agree that CSC Pacific  reserves the right to deny any application to any person or to terminate any person’s status as a Guest in the event that CSC Pacific  determines, in its sole discretion, that the outcome of the searches is not satisfactory

8. No Publicity and Marketing Rights. I acknowledge and agree that I will not publicly disclose my relationship with CSC Pacific for promotional purposes, including by means of distribution of literature, verbal declarations or announcements through any medium whatsoever (including any sales, marketing or other literature, letters, press releases, brochures, website content or other written materials), without the express prior written consent of CSC Pacific, which consent may be arbitrarily withheld. I undertake not to use “Canadian Sport Centre Pacific”, “CSC Pacific” , “Billet Program”, “Athlete Family”, “Own the Podium 2010”, “VANOC”, “Vancouver 2010”, any official emblem, logo or mascot of the Games or any other CSC Pacific, NSF, OTP, VANOC, COC, or CPC identification or trademark, as a reference or means of promotion or publicity, without the express prior written consent of CSC Pacific, NSF, OTP, VANOC, COC, or CPC, which consent may be arbitrarily withheld. I undertake not to disclose or promote my relationship with CSC Pacific, the NSFs, the COC, the CPC, OTP or VANOC in any communication or manner whatsoever as a basis to create an association, express or implied, between myself and the IOC, the Olympic Games, the Olympic Movement, the IPC, the Paralympic Games or the Paralympic Movement.

9. Choice of Law. This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein and the parties agree and consent to the exclusive jurisdiction of the courts of British Columbia.

10. Confidentiality. I agree that the terms and conditions of this Agreement and the personal information of my Host will at all times remain confidential and I will not disclose them to any person without CSC Pacific’s prior consent, unless required by law.

11. Understanding of Agreement. I represent to CSC Pacific that I fully understand the terms of this Agreement and have had the opportunity to seek any legal, translation or other advice that I have considered necessary in determining whether to participate in the Program.
